Throughout this article, the terms “we”, “us” and “our” are used to refer to AquaHome. The term “services” refers to any product created by AquaHome delivered via our mobile apps, websites or through any other format.

By using our services, you are agreeing to the latest terms of service outlined here. If you do not wish to agree to these terms then you are not permitted to use our services. If you violate any of the terms in this agreement, we may terminate your account.

We may update these terms periodically. You can check the latest revision by looking at the date above.

1. Your Content

You retain all intellectual property rights to any content you upload including the copyright to your photos. We do not claim any ownership, right, title or interest to your content.

By uploading content to our services, you grant us a perpetual, nonexclusive and royalty-free right to use the content as is reasonably necessary in order to provide our services, including to display the content, or adaptation of the content, on our services and to comply with legal requirements, such as disclosing content in response to legal process from governmental authorities.

When we terminate an account for any reason, all content associated with the account may be removed. While we will use reasonable efforts to notify you of such removal, it is your responsibility to download any content which you wish to save and make backup copies of all content to prevent the loss thereof.

2. Accuracy Of Information

The information contained in our services, including text, images and other sources of information, are for informational purposes only. We are not responsible for any inaccuracies or lack of completeness. Reliance on any information or content on our services is at your own risk.

3. Prohibited Uses

You may not:

Edit, reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display or otherwise exploit the content on our services unless expressly permitted in writing by us. In the case of any content on our services provided under an open source license, the provisions of that license may override this.
Remove any copyright, trademark or other proprietary rights notices from content on our services
Reverse engineer or decompile our services, attempt to do so, or assist anyone in doing so
Utilise any programs or scripts for the purpose of scraping, indexing, measuring or otherwise data mining any parts of our services that may hinder the functionality or performance of our services

4. Liability

You expressly understand and agree that we shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use our services; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from our services; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; (v) or any other matter relating to this terms of service or our services, whether as a breach of contract, tort (including negligence whether active or passive), or any other theory of liability.
